Tommy Eden, a native of Auburn, Alabama, was born in 1953. He graduated from Auburn University in 1976 and then attended Cumberland School of Law, Samford University, where he graduated in 1980 cum laude. After graduation, Tommy worked in Atlanta, Georgia, with the management labor law firm of Constangy, Brooks & Smith, and subsequently joined the Birmingham firm of Spain and Gillon in 1983, where he continued his management labor and employment law practice. Also, while at Spain and Gillon, Tommy defended a number of insurance companies in substantial fraud and bad-faith litigation. Tommy subsequently joined the Birmingham firm of Wallace, Jordan, Ratliff & Brandt, L.L.C. in 1996.
Tommy joined Capell & Howard, P.C. as a member in December 2006. Mr. Eden's law practice is principally in the areas of Management Labor and Employment Law, Drug Testing Law (DOT Regulated and Non-Regulated) throughout the United States; defense of employers in federal court in all aspects of employment litigation including claims under Title VII, ADA, FMLA, FLSA, ADEA, and retaliatory discharge actions; defense of employers in charges brought with the EEOC, Wage and Hour Division, National Labor Relations Board, and the Department of Labor; and litigation over employee benefits under ERISA.
Other preventative services offered include: Employee handbook drafting; basic and advanced employment law audits; essential employment forms; effective and defensible discipline and termination counseling; various types of supervisory employment law compliance training; FMLA compliance programs and counseling; Drug-Free workplace programs and counseling; employee misconduct investigations; harassment prevention programs, training and investigation; affirmative action programs and training; employee arbitration programs; web based customized employee orientation and training; church handbooks; Child Protection First! programs; and, customized employee orientation videos.
