Capell & Howard Attorney Terrie Scott Morgan obtained relief for her client, a retired Army National Guard warrant officer, in the Alabama Supreme Court. In a rare decision, the Alabama Supreme Court reversed the Court of Civil Appeals in a modification of periodic alimony case. Clarifying Alabama law regarding the time period for which a material change of circumstance is considered, the Supreme Court held that the trial court should consider evidence from the time alimony is initially set or last modified rather than from the date of the most recent judgment disposing of a claim for modification in determining the material change of circumstance. The case was reversed and remanded for the court’s determination in a request to terminate her client’s periodic alimony and life insurance obligation. Click here to view the Opinion.
