On July 8, the Alabama Supreme Court ruled in favor of a Capell & Howard client, represented by attorney and shareholder W. Allen Sheehan, and affirmed the appellate court in overturning the trial court’s decision to reform a 30-year residential lease contract. Allen represented the defendants in their appeal to the appellate court, the Alabama Court of Civil Appeals, to seek reversal of the trial court’s judgment.
During the initial trial on the matter in early 2015, the judge sided with the plaintiffs and ordered the lease contract to be restructured. The defendants, through Allen, appealed the cased to the Alabama Court of Civil Appeals last year, and the Civil Appeals Court overturned the trial court’s ruling and rejected the contract’s reformation. Accordingly, the plaintiffs then appealed the appellate court’s decision to the Supreme Court, where the plaintiffs’ request was struck down.
