Capell & Howard’s W. Allen Sheehan secures monetary judgment for client in breach of contract, fraud suit

On August 17, Capell & Howard attorney and shareholder W. Allen Sheehan persuaded jurors in the Macon County Circuit Court to rule on behalf of his clients, the plaintiffs in the suit, and award them a monetary judgment after a house moving company caused damage to the plaintiffs’ home.

In February of 2015, a couple (the plaintiffs) hired a house moving company (the defendant) to relocate their 1940s home, a family-built home with much sentimental value. In preparing the home to be moved, the moving company caused portions of the home to collapse, causing damage to the inside and outside of the home. The house moving company then threatened to remove its equipment, which was the only thing stabilizing the house at the time.

The couple retained Allen, and he immediately filed a temporary restraining order to prevent the house moving company from removing its equipment, along with a lawsuit against the moving company and its employees. At the close of the trial, Allen secured for the couple compensatory damages against both the moving company and an individual employee.
