On April 9, 2020 and on April 17, the EEOC issued additional new guidance for employers. In the new “Technical Assistance Questions and Answers” on COVID-19 and the ADA and other equal employment laws, the EEOC addressed a broad variety of topics. These topics include: confidentiality of medical information, hiring and on-boarding, ADA accommodation requests, pandemic-related harassment due to protected characteristics, return to work, and furloughs and layoffs. Given the rapid pace of the government’s release of new guidance for employers, it is increasingly difficult for a business owner to keep up with changes in the law and to run a business.
